ELEMENTS AND REFLECTIONS ON SUCCESS, FAILURES, AND LESSONS LEARNED IN INTERNATIONAL MEDIATION

by Esra Cuhadar (Bilkent University, Turkey)

This TP focuses on some key issues related to the discussion of mediation success. Some of the issues that will be covered are: success criteria used by scholars to evaluate mediation outcomes and independent variables discussed that explain mediation success. These variables are usually grouped into two categories as context and process variables. The following variables are scrutinized in detail throughout the course: nature of the dispute (ripeness, conflict intensity, nature of the conflict), relationship between conflict parties (readiness, constituency relations), bias and impartiality of the mediator, sequencing and complementarity of mediator strategies and activities, and inclusivity and local ownership in the mediation process. The TP will explore the dynamics outlined above through presentations by the instructor, class discussion, and analysis of case studies.

    GENDER AND MEDIATION

    by Julia Palmiano Federer (swisspeace)

The course will pay particular attention to the debate between a normative and pragmatic approach to mediation, focusing on the normative framework of gender and its relationship to mediation practice. It is relevant as the nexus between gender and mediation is normatively loaded and has important implications for mediation policy and practice. While promoting gender as a norm per se is difficult to question ethically, mediators and practitioners grapple daily with how to incorporate gender norms into their mediation strategies and process design. Mediators also face increasing pressure from their mandate givers to incorporate gender considerations, jump starting a debate on whether gender considerations such as promoting the participation of women and guaranteeing gender sensitive clauses in peace agreements should be done within the parameters of a mediation process.

    INTERNATIONAL MEDIATION: ACTORS AND PROCESSES

    by Sara Hellmuller (swisspeace)

This TP will introduce the main actors and processes involved in international mediation. It will first clarify definitional aspects on what mediation entails, how it works (roles of mediators) and when it is appropriate as a tool to settle conflicts (ripeness). It will then also analyze who the actors are, what motivates them and what their comparative advantages are. Finally, it will assess how to measure success and failures of international peace mediation and analyze current trends in the field.
